Welcome! These are the rules for using the Endangered Languages Project (ELP) website. We want everyone to feel safe, respected, and informed. Please read these terms before using our site.
 

A. Using Our Website Means You Agree

By using our website (www.endangeredlanguages.com), you agree to follow these rules and our Privacy Policy. If you don’t agree, please don’t use the site.
 

  1. You must be at least 18 years old, or have permission from a parent or guardian, to use our website. If you’re not old enough or don’t have permission, please don’t use the site.
  2. We May Update These Rules. We might change these rules sometimes. If we do, the new rules start right away. If you keep using the site, it means you accept the changes. Check this page now and then to stay up to date.
  3. Access and Account Safety. Sometimes, parts of the website might not be available. We can change or remove parts of the site at any time.
  4. If you make an account, keep your password private. Don’t share your login details with anyone. If you think someone else is using your account, email us right away at feedback@endangeredlanguages.com.

 

B. Community Guidelines

We want ELP to be a welcoming place for everyone. Please:

  • Be respectful and kind to others.
  • Don’t post hateful, discriminatory, or harmful content.
  • Respect people’s privacy and don’t share information or materials you don’t have permission to share.
  • Stay on topic—keep discussions about language.
  • Don’t post illegal, violent, or explicit content.
  • Help us keep the community safe by reporting anything that breaks these rules.

C.  Respect for Indigenous Data Sovereignty

Many languages represented on the ELP site belong to Indigenous Peoples. We respect the rights of Indigenous Peoples to control how their languages and knowledge are shared. By using ELP’s website or services, you agree to:

  • Respect Indigenous Peoples’ rights and decisions about their languages, cultures, and knowledge.
  • Only share materials and knowledge if you have permission.
  • Never share language or knowledge that is sacred, secret, or private.
  • Approach all languages and materials with respect, responsibility, and care.

D. Intellectual Property

Everything on this website (text, images, software, etc.) belongs to ELP or others who gave us permission. You can use the site for your own personal, non-commercial use. Don’t copy, share, or change anything unless we say it’s okay. If you want to use something in another way, ask us first at feedback@endangeredlanguages.com.
 

E. Trademarks

The ELP name and logo belong to us. Don’t use them without our written permission. Other names and logos on the site belong to their owners.

 

F. What Not to Do

Please use the website legally and respectfully. Don’t:
 

  • Break any laws.
  • Harm or try to harm anyone, especially minors.
  • Post anything that breaks our Community Guidelines.
  • Send spam or unwanted ads.
  • Pretend to be someone else.
  • Collect or misuse other people’s personal information.
  • Interfere with how the website works or try to access parts you shouldn’t.
  • Use robots or software to copy the site.
  • Use any part of the site to train, test, or fine-tune AI or machine learning models. 
  • Spread viruses or harmful software.
     

If you break these rules, we may remove your materials or ban you from the ELP site.
 

G. Information on the Site

The information on ELP is for general knowledge. We try to keep it accurate, but we can’t promise it’s always correct or up to date. Use it at your own risk.

 

H. Changes to the Website

We may update or change the website at any time. Some information may be out of date.
 

I. Linking to and from ELP

You can link to our website as long as it’s fair and legal. Don’t suggest ELP supports or endorses you unless we say so. We may remove linking permission at any time.


We sometimes link to other websites. We’re not responsible for their content or safety. Use them at your own risk.


J. Where You Can Use ELP

ELP is based in Oregon, USA, but people all over the world can use our site. If you use the site from outside the US, make sure you follow your local laws.
 

K. No Guarantees

We do our best, but we can’t guarantee the website will always work perfectly or be free of bugs or viruses. Use the site at your own risk.


L. Limitation of Liability

ELP and its team aren’t responsible for any damages, losses, or harms from using the website. This includes direct or indirect damages, even if we were warned it might happen.

  1. Acceptance of the Terms of Use

These Terms of Use (“Terms”) are entered into by you and Endangered Languages Project (“ELP,” “we,” or “us”). The following terms and conditions govern your access to and use of www.endangeredlanguages.com (our “Website”), whether as a guest or a registered user.

Please read these Terms carefully before you use our Website. By using our Website, you accept and agree to be bound and abide by these Terms and our Privacy Policy, incorporated by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use our Website. 

Our Website is offered and available to users who are 18 years of age or older. By using our Website, you represent and agree that you are of legal age to form a binding contract with ELP and meet all of the foregoing eligibility requirements, or that you are of legal age and you have given your consent to allow any of your minor dependents to use our Website. If you do not meet these requirements, you must not access or use our Website.

  1. Changes to the Terms of Use

We may revise and update these Terms from time to time at our discretion. All changes are effective immediately when posted. Your continued use of our Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding.

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, for users, including registered users.

You are responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and comply with them.

To access the Website or the Website, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide on the Website is correct, current, and complete. We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

  1. Community Guidelines

ELP is meant to be a welcoming, safe, and helpful place for supporting languages and language communities. To keep our community healthy, we ask you to read and follow these community guidelines. 

  • Communicate with respect. Treat other people respectfully at all times. Don’t insult, harass, threaten, bully, or demean anyone. Respect other peoples’ languages, experiences, perspectives, understandings, histories, contexts, and cultural knowledge. 
  • Hate has no place here. Any content promoting hate or discrimination based on race, ethnicity, language, gender identity, age, sexual orientation, nationality, socioeconomic status, cultural background, religion, appearance, or disability – or any other kind of hateful behavior – is strictly prohibited. 
  • Respect privacy and protocol. Do not ever share personal information about other people without their permission. Do not share knowledge, language, language materials, cultural materials, cultural practices, etc. (“knowledges”)which you don’t have permission to share. Do not share knowledges  which are sacred, secret, private, or should not be public for any other reason. 
  • Stay on topic. This is a community for discussing topics related to language. Don’t post things that are totally unrelated to language. Don’t spam or sell things. 
  • No illegal or explicit materials. Don’t share or post anything that is illegal, violent, pornographic, or unsafe for people of all ages to see. 
  • Help keep the ELP community safe. Report anything you see on the ELP site that violates these guidelines. Use the flagging feature, contact a moderator, or email us. 

The ELP moderation team reserves the right to remove content, or ban users, that violate these guidelines.

  1. Respect for Indigenous Data Sovereignty

ELP supports global efforts to revitalize and document endangered languages, many of which belong to Indigenous Peoples. The ELP team recognizes that languages and language work exist within and through relationships, cultures, and communities, and we acknowledge, recognize, and respect the ongoing presence, self-determination, and authority of Indigenous Peoples whose homelands and knowledge systems are represented in our platform.

ELP is committed to upholding Indigenous data sovereignty, which recognizes, respects, and upholds the rights of Indigenous communities to control how their knowledges are represented, shared, and used. These rights include:

  • The right to govern access to language and cultural materials,
  • The right to determine how those knowledges are accessed, used, or shared,
  • The right to be acknowledged, recognized, and respected as the source and stewards of those knowledges.

By using this Website, you agree to:

  • Respect Indigenous Peoples’ rights to self-determination, cultural governance, and data sovereignty;
  • Not post or share language or cultural materials unless you have received proper permission;
  • Avoid sharing any knowledge that is sacred, secret, private, or otherwise restricted from public disclosure;
  • Engage with materials and communities represented on the site with respect, responsibility, humility, and cultural sensitivity.

We encourage all users to approach this work with care and an awareness of the historical and ongoing impacts of colonization, including the appropriation of Indigenous knowledge. ELP reserves the right to remove any content that violates these principles.

  1. Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ELP, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to access and use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

  1. Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  2. You may store files that are automatically cached by your Web browser for display enhancement purposes.
  3. You may print or download one copy of the ELP Catalogue of Endangered Languages (ELCat)  for your own personal, academic, educational, research, and any other non-commercial use and not for further reproduction, publication, or distribution without appropriate citation to ELP as an organization.
  4. If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
  5. If we provide social media features with certain content, you may take such actions as are enabled by such features.

 

You must not:

  1. Modify copies of any materials from this Website.
  2. Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Website.

 

If you wish to make any use of material on the Website other than that set out in this section, please address your request to feedback@endangeredlanguages.com.

 

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Website in breach of the Terms, your right to use the Website will stop immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted are reserved by ELP. Any use of the Website not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

  1. Trademarks

The ELP name, the ELP logo, and all related names, logos, product and service names, designs, and slogans are trademarks of ELP or its affiliates or licensors. You must not use such marks without the prior written permission of ELP. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

  1. Prohibited Uses

You may use our Website only for lawful purposes and in accordance with these Terms. You agree not to use our Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries). 
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
  • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Community Guidelines Standards set out in these Terms.
  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
  • To impersonate or attempt to impersonate ELP, a ELP employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
  • To collect, misuse, or attempt to collect or misuse other people’s personal information.
  • To use the Website, its content, or any data obtained from it to train, develop, or operate artificial intelligence systems or tools.
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm ELP or users of the Website, or expose them to liability.

Additionally, you agree not to:

  • Use the Website in any manner that could disable, overburden, damage, or impair the Website or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website.
  • Use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.
  • Use any manual process to monitor or copy any of the material on the Website, or for any other purpose not expressly authorized in these Terms, without our prior written consent.
  • Use any device, software, or routine that interferes with the proper working of the Website.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website. 
  • Attack the Website via a denial-of-service attack or a distributed denial-of-service attack.

You agree to defend, indemnify, and hold harmless ELP, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Website, including, but not limited to, any use of the Website’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Website.

  1. Governing Law

All matters relating to the Website and these Terms, and any dispute or claim arising from or related to these Terms, shall be governed by and construed in accordance with the internal laws of the State of Oregon without giving effect to any choice or conflict of law provision or rule (whether of the State of Oregon or any other jurisdiction).

  1. Dispute Resolution and Binding Arbitration.

You and ELP are agreeing to give up any rights to litigate claims in a court or before a jury. Other rights that you would have if you went to court may also be unavailable or may be limited in arbitration.

Any claim, dispute, or controversy (whether in contract, tort, or otherwise, whether pre-existing, present, or future, and including statutory, consumer protection, common law, intentional tort, injunctive and equitable claims) between you and us arising from or relating in any way to your purchase of products through the Website, will be resolved exclusively and finally by binding arbitration.

The American Arbitration Association (“AAA”) will administer the arbitration in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect. The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879. The Federal Arbitration Act will govern the interpretation and enforcement of this section.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator will be final and binding on each party and may be entered as a judgment in any court of competent jurisdiction.

If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.

  1. Waiver and Severability

No waiver by ELP of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of ELP to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions.

  1. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and ELP regarding the Website and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website and Services. 

  1. No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you.

  1. Notices

To You. We may provide any notice to you under these Terms by (i) sending a message to the email address you provide or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
